Types of Casualty Insurance Coverage

When we handle auto accidents, truck accidents and some wrongful death cases, we deal with casualty insurance companies. Below are listed some basic types of coverage.

Personal Injury Protection (PIP)

This is what your own insurance company pays if you are injured for your medical bills and a portion of your lost wages, regardless of fault. If you are hurt in an accident, your PIP will pay in addition to the liability insurance of the person at fault.

Property Damage

There are two types of car insurance coverage: liability only and full coverage. If you have full coverage, and you are in an accident that is your fault, your property damage coverage will cover car repairs for collisions. It also covers perils that are not your fault, such as damage caused by animals, the weather, or falling objects.

If you are in an accident that is not your fault, and you have full coverage, you have two options: you can go through your own insurance company and pay the deductible, or go after the other person's liability coverage. There are advantages and disadvantages to both.

Uninsured and Underinsured Motorist Coverage (UM/UIM)

This type of coverage automatically comes with all insurance policies unless you have waived this coverage in writing. This coverage takes effect if 1) you are in an accident, 2) the other driver is at fault, and 3) the other driver has no insurance or not enough insurance to compensate you for your injuries.

Liability Coverage

If you are in an accident, and it is your fault, your insurance company is obligated to pay for the other person's injuries and property damage up to the limits of your coverage.

Property Insurance

If you are a homeowner, you most likely have a property insurance policy. Property insurance companies represent defendants in such claims as premises liability, construction accidents, and dog bite cases.

All property policies have a personal (or commercial) liability limit. Whenever there is a lawsuit, this is the portion that pays compensation to the injured party.

First Party Insurance Claims

A first party insurance claim is a claim brought by a policyholder against his or her own insurance company. These types of claims can be in response to damage to a home, an auto accident involving an underinsured or uninsured driver or coverage for a medical claim. Anytime an insurance company is dealing with a first party claim, it is expected that they treat their insured in good faith. If a first party claim is denied, it may be possible for us to take action against the insurance company to seek the payment of a legitimate claim that is covered by your policy.
